THE OMBUDSMAN INSTITUTION OF THE REPUBLIC OF TÜRKİYE



               Considering  that  in  the  rapidly  changing,  developing  and  transforming  world,  the
               services offered by the public are diversified and complicated; in cases where the
               public administration cannot catch up with this speed and therefore remains slow
               and cumbersome, where laws may be strict for the same reasons, and where people’s
               freedoms can be restricted as a result, and where disruptions may occur in access to
               public services and justice, fairness control as an understanding of justice softened by
               feelings of fairness, mercy and compassion appears as a complementary element in the
               administration of justice. Fairness control also fills important gaps within the framework
               of sensitivities such as “not sacrificing the interests of the general society to private
               interests while defending private interests against the administration, not being subject
               to heavy sanctions on behalf of the interests of the society, and observing the equal
               sharing of the sacrifices to be made on behalf of the society”.

               The duty of ombudsman, which I have internalized in this framework, has been carried
               out with tenacity and determination since November 2016, under the guidance of Chief
               Ombudsman Mr. Şeref Malkoç and with the support that I have received from my
               expert team. In 2022, thousands of complaints under the titles of “education, youth and
               sports”, “Energy, industry, customs and trade”, “Economy, finance and tax”, “Science,
               art, culture and tourism” and “Other subjects and fields” in terms of the main subjects
               and areas of the division of work in the Ombudsman Institution, were examined and
               decisions were issued with my team of experts. Complaint applications mainly come
               from the subjects of “Education” and “Economy, finance and tax”, while the subject of
               “Energy, industry, customs and trade” takes the third place. I would like to state that not
               many applications were received in a very important field such as “science, art, culture
               and tourism”.
               As exemplary applications and decisions affecting large masses, in the field of “education,
               youth and sports”, we received many applications with the request of canceling the 2022
               Public Personnel Selection Exam (KPSS) held on 31.07.2022 and holding a new exam.
               While the examination-investigation process initiated by the Ombudsman Institution
               was in progress, the applications were finalized with an amicable settlement with the
               cancellation of the exam.  Under the title of “Economy, finance and tax” on the other
               hand, a large number of applications requesting updating of bank promotions for
               public employees were received, and after the investigation, considering the economic
               developments, the increase in market prices and the practices of public institutions that
               have updated the contracts regarding promotional payments, it has been concluded
               that it is possible to renew the contract amounts before 2022 and the promotional
               contract amounts made in the recent periods, and Recommendations were issued as
               the mentioned requests should be reconsidered. Under the title of “Energy, industry,
               customs and trade”, we received many from those staying in penitentiary institutions
               demanding their grievances to be compensated, stating that their electricity consumption
               fee is collected on the basis of the “business subscriber group”, and therefore the
               electricity consumption cost has reached considerably higher amounts compared to the
