by local administrations, transportation, press and communication have been
examined and researched in detail by prioritizing the rights of human beings and
good administration principles. As a result of these examinations and investigations,
decisions have been issued on many issues such as in the field of human rights: from
prisoner applications to the privacy of private life and the protection of personal data,
in the field of civil registration, citizenship, refugee and asylum-seeker rights: civil
registration procedures, problems of immigrants, asylum seekers and refugees, under
the title of services provided by local administrations and which are based on right
to property: zoning procedures and practices, which are, water services that ensure
the right of access to a healthy environment and clean water, and under the title of
transportation, press and communication: from problems experienced in vehicle
inspections to ensuring the fulfillment of the required inspection and surveillance
obligations regarding the telecommunication market.
Good administration, in the most general sense, is to act in accordance with the
procedures and rules stipulated for carrying out a certain activity. In this regard,
the Ombudsman Institution communicates with the public administrations in both
writing and verbally and conducts examinations and investigations regarding the
applications received, and issues recommendations to the administrations in order
for the administration to act in accordance with the good administration principles.
The main duty of the Ombudsman is to act as a bridge between the citizen and
the state and to carry out a kind of mediation activity. A change in the practice,
due to the decision issued by the Ombudsman Institution, can affect thousands,
sometimes hundreds of thousands of people who are in the same position as the
applicant. Since one of our duties as the Ombudsman Institution is to force the
administration to comply with the principles of good administration, the examination,
investigation are conducted and recommendations are issued by communicating
with the Administration resulted in the settlement of many complaints in this area
through consensus (amicable). The meetings we held with the Administrations in
order to solve the problems expressed in the applications, on the subjects where
the applications are concentrated, encouraged the Administration to the “Good
Administration” practices, and also ensured that the problems of the citizens who
did not apply to the Institution were resolved.
With the responsibility of being a constitutional institution, since the day it was
established, our Institution presents what needs to be done as well as what has been
done regarding important social developments in particular to policy makers through
special reports, which are prepared as a result of the examination of the applications
received. In this way, it conduces to prevent problems at their source. As a matter of
fact, the Ombudsman Institution, within the framework of its mission and vision, has
been closely interested in the issue of migration, which has directly affected Türkiye,
especially after the Syrian crisis, and has carried out studies on the subject. “Special
Report on Syrians in Türkiye” prepared in 2018 is an example of this.
