THE OMBUDSMAN INSTITUTION OF THE REPUBLIC OF TÜRKİYE

Among the complaints lodged, applications for violations of rights in penal institutions
and other closed institutions, petitions and obtaining information, elect and election,
citizenship, travel, assembly and demonstration rights, freedom of thought, conscience
and belief, prohibition of torture and ill-treatment have priority.

Case Summary

In one application, it was requested to protect the right to respect for private and
family life of the convict, who was not allowed to attend the funeral of his parents
on the grounds that the gendarmerie would have difficulty in taking precautions due
to the COVID-19 pandemic. As a result of the examination and research carried out
by our institution, the convict in question was allowed to go on a condolence visit by
compassionate leave.

Case Summary

In yet another application, the applicant's conditional release date was 26/08/2021, a
kidney tumor was detected, as a result of surgery on 28/04/2021, one of his kidneys
was removed, it was understood that he had cancer according to the pathology results,
he was not admitted to current and effective cancer treatments due to the execution
regulations, the doctor stated that he did not have a life expectancy filed a petition to
the administration to take advantage of probation measures, but it was stated that he
would be subject to a two-month observation period by the administration, it was not
actually possible for the administration to observe him because he had been treated
in the hospital for more than two months, probation and postponement of execution
although the applicant was requested to be released on probation, it was claimed that
he had not received any results yet, and due to the serious risk of his health condition,
the applicant's release was requested less than three months before he was released on
probation. As a result of the investigation and research carried out by our institution, it
was stated that the person in question was released.
WOMEN'S RIGHTS

Applications made to our institution in the field of women's rights are examined without
seeking any violation of interests (infringement of interest). Although all kinds of
violence against women, honor killings, harassment and abuse are constantly occupied
the public, as in previous years, a very limited number of individual applications are
made to our Institution on these issues, and since there are mostly judicial cases and
they are usually referred to the judicial organs, it falls outside the scope of duty and
authority of the Institution. In the applications on these issues, even though Decisions
of Inadmissibility are issued in accordance with the relevant articles of Law No. 6328,
for each application file, the situation of women is evaluated by the social service
specialist in our institution and information is provided about the public services they
can benefit from in line with their needs and demands, and counseling can be offered.
