THE OMBUDSMAN INSTITUTION OF THE REPUBLIC OF TÜRKİYE
• Contracted and temporary personnel issues
• Personnel within the scope of privatization
• Staff(cadre) and/or positions
• Examinations regarding the recruitment of personnel to the public (written and oral
examinations conducted by the institutions regarding the recruitment of personnel)
• Complaints about the attitudes and behaviors of public personnel (including
mobbing and ill-treatment)
Case Summary
In an application, it was stated that the applicant, who worked as a social security
inspector in the Provincial Directorate of Social Security, used her maternity leave,
then requested unpaid leave, her request was not deemed appropriate because she had
not completed her current tasks, but the provision of Law No. 657 did not give the
administrations discretion in this matter. It was requested that the right to unpaid leave
be exercised.
In this context, it was evaluated that the procedures established to reject the applicant's
request for unpaid leave after maternity leave were not legally appropriate, and it was
recommended to the İzmir Provincial Directorate of Social Security for the applicant to
benefit from her right to unpaid leave.
Case Summary
In an application, the applicant demanded the termination of mobbing, stating that he
was a victim of the mobbing and he applied to the administration regarding the issue,
but could not achieved a result.
As a result of the examinations and researches, acknowledging that the attitudes,
behaviors and transactions that contain mobbing elements are misbehaved, Gaziantep
Metropolitan Municipality has been advised not to engage in behaviors that will be
perceived as mobbing from now on.
