where stray animals are found; furthermore, order to feed stray animals, and if the
owners of restaurants, workplaces and factories in their region deem it appropriate,
take necessary measures to collect foods suitable for feeding animals from businesses
and kitchens. Also, according to the Law, governorships (Provincial Directorates of
Agriculture and Forestry and Provincial Animal Protection Boards) are responsible for
monitoring the control of stray animals, identifying problems related to the protection
of animals within the provincial borders, taking all kinds of measures for the protection
of animals and conducting necessary inspections to ensure the implementation of
Regulation on the Protection of Animals.
The provisions of the Law No. 5199, which stipulate that stray animals are rehabilitated
and released to the environment where they were taken, support the lives of stray
animals that live in the environments where they are released. In this direction,
necessary precautions should be taken in order to prevent hunger that may put their
lives at risk, to protect them from the pain, suffering and diseases they may suffer if
they are hungry, ensure their well-being and prevent all kinds of grievances, establish
nutrition centers for the feeding of stray animals and collect of foods suitable for animal
nutrition from the enterprises in the region where these animals live. As a matter

of fact, in the 14 article of the aforementioned Law, titled “Bans”, it is prohibited
to leave animals hungry or thirsty, to neglect their care, or to cause them physical
and psychological pain. Indeed, the access of stray animals to suitable food in the
environments they live in is an essential issue both for the continuation of their lives
and for the protection of the environment and human health. A Referral Decision
was issued to the relevant administrations with the assessment that otherwise it may
become possible to experience situations that may be contrary to the rules stipulated in
the Law No.5199 for the protection of stray animals, and contrary to the purposes and
principles of the Law. 16
7.12 HUMAN RIGHTS
In 2021, a large number of applications were submitted to the Ombudsman Institution,
alleging violations of fundamental rights and freedoms. Although the majority of the
applications in question are of an individual nature, it is seen that some concrete
violation allegations have also been submitted to the Ombudsman Institution by
lawyers, non-governmental organizations and professional organizations, even political
parties and deputies. This situation also indicates the existence of trust towards the
Ombudsman Institution in the eyes of the public and individuals.
