institutions were urgently contacted. The applicant’s complaint was resolved with the
initiatives of the Ombudsman Institution. In the thank you e-mail sent by the applicant
to the Ombudsman Institution, he stated that the record that caused the deduction of
his home care pension was corrected with the support of the Ombudsman Institution
and that he was notified that his unpaid pensions would be paid to him retroactively. 15
7.11 FOOD, AGRICULTURE, AND LIVESTOCK
Applications under this title are about payment of cash collateral in the context of
agricultural loans and incentives, agricultural subsidies, construction of farm (vineyard)
house on agricultural land, claims of violation of animal rights, feeding stray animals,
food safety, and honorary hunting inspectorship. Regarding the applications in
question, amicable settlement efforts are initiated firstly, and the administrations are
invited to act in accordance with the principles of good administration. For example,
in an application made with the request to indicate the fact the counterfeiting and
commingling establishment in the list published by the Ministry was another business
operating at the same address.
CASE SUMMARY
In this context, applications were lodged to the Ombudsman Institution for the
fulfilment of the duties and responsibilities stipulated in the Animal Protection Law
No. 5199 in terms of feeding and caring for stray animals. As a matter of fact, the
applications stated that there are many kittens/adult cats and dogs in the Village
where the applicants live, and that although they share their meals with them, their
financial conditions are not suitable to feed them continuously. They explained that
they requested food from the Administrations in order to feed these animals, but
their requests were rejected, and they requested that the food demand to be met in
accordance with the provisions of Law No. 5199.
These applications were carefully examined by the Ombudsman Institution, and the
relevant provisions of the Animal Protection Law No. 5199, and the Implementation
Regulation on the Protection of Animals were reminded to the administrations. The
purpose of the Law No. 5199 on the Protection of Animals is to ensure the comfortable
life of animals, the good and appropriate treatment of animals, protecting of animals
from pain, suffering and cruelty in the best way and the prevention of all kinds of
victimization. In this direction, some acts against animals are prohibited in the Law
and administrative or judicial sanctions are envisaged for the persons who commit the
act, depending on the nature of the act. The Law also stipulates that municipalities are
responsible to help feeding stray animals by establishing feeding centers in environments
