6.5 GENERAL EVALUATION ON THE ADDED VALUE OF THE
OMBUDSMAN INSTITUTION TO OUR COUNTRY
In the general rationale of the Law No. 6328 on the Ombudsman Institution, it is
stated that "...it is aimed that the administrations take into consideration and comply
with the proposals of the Institution as much as possible and reduce the burden of the
administrative judiciary ...” Therefore, as an Institution that supports the administrative
judicial authorities, which dealt with approximately 800 thousand case files in 2022,
and that reduced their workload by establishing rapid access to justice is among the
main goals of the Ombudsman Institution.
In this framework, with a total of 18,094 decisions were issued as a result of the
examination and research carried out by the Ombudsman Institution, the Institution
has also helped to increase the quality of public services and to establish a transparent,
accountable and people-oriented administration. Moreover, 2,194 of the applications
lodged in 2022 were resolved through amicable settlement. Again, as a result of the
examination and investigation conducted by the Ombudsman Institution, a total of
1,722 Recommendations, 625 of which were Partial Recommendations, contributed
to reducing the workload of the courts. On the other hand, a total of 1,017 Refusal
Decisions that were issued in the same period may lead to a decrease in the rate of
people applying to the judiciary, as the applicants are informed that their request cannot
be fulfilled within the framework of the legislation.
In addition to examining complaint applications, the Ombudsman Institution also
meets the information requests of individuals. In 2022, a total of 162,143 information
requests were met through the information bureau, which functions like a call center.
With 4,933 Amicable Settlement, Refusal and Recommendation Decisions issued and
legal remedies provided as a result of the examination and investigation carried out
by the Ombudsman Institution, the Institution directly contributed to reducing the
workload of the courts, as well as helping to increase the quality of public services and
to establish a transparent, accountable and people-oriented administration. As a result
of all these, the Ombudsman Institution became an intermediary for the citizens to
supervise public institutions and organizations with the complaints it examined. Apart
from the elections held every five years, the participation of the citizens in the state
administration, especially in the local administrations, has been ensured. Thus as an
instrument of direct democracy, the Ombudsman Institution has contributed to the
strengthening of democracy in Türkiye.
