7. INFORMATION AND EVALUATION REGARDING THE
APPLICATIONS
7.1 JUSTICE, NATIONAL DEFENSE AND SECURITY
In 2022, under the title of “Justice, National Defense and Security”, applications with
requests and complaints of those who are detained or convicted in prisons about following
issues were examined: prison conditions, video phone calls, weekly meetings, healthy
nutrition of prisoners/convicts, decisions of the administrative and supervisory board,
decisions of the execution judge, disciplinary penalties given by prison directorates,
requests that the food provided in the penitentiary institution to be complied with
healthy nutrition conditions, requests to be transferred to a prison to the city where
the prisoner’s family reside or to a nearby city, applications for problems experienced
regarding contact or non-contact visitations, health problems, implementation of the
provisions of the “Bylaw on Rewarding Convicts and Prisoners”, conclusion of the
cases to which they are a party as soon as possible, ensuring that the decisions made
by the courts are reviewed and retrials are carried out, traffic fines, failure to collect
court attorney fees, to be added to the expert list, deletion of criminal record, legal
internship logs, updating the fee schedule for compulsory defense attorney assignments,
the application of late payment interest to court decisions, requests for expert trainings.
CASE SUMMARIES
As in previous years, the Ombudsman Institution kept receiving applications from
detainees and convicts kept in penitentiary institutions about healthy nutrition
concerns. The subject of the lodged complaints were about issues such as supplying the

food recommended to them by the dietitian , improving the standards of the drinking

water and meals in the penitentiary institution , ensuring that the food provided in the
3
penitentiary institution comply with healthy nutrition conditions .
In addition to corresponding with the relevant administrations, the Ombudsman
Institution continues its investigation by obtaining medical opinions from health
institutions, if necessary. The right to life, which is one of the most basic and
indispensable rights, is protected by Article 17 of the Constitution of Türkiye and the
Article 2 of the European Convention on Human Rights and Article 6 of the Covenant
on Civil and Political Rights. The right to life also includes the right to be protected
by public authorities against dangers and risks to life. It has been emphasized that the
general living conditions specified in international conventions and recommendations
