V of the Human Rights Action Plan and Implementation Calendar. In this context,
the Ombudsman Institution observed that 224 of the 393 activities stipulated in the
Human Rights Action Plan have been completed, 14% of the 169 unfinished activities
are at the beginning level, 17.3% of them have made progress, and 11.7% of them
are activities that are close to completion. It is seen that most of the activities that are
not completed require a legislative change, and that the activities that do not require
legislative changes require a long preparation process or the activity is continuous (such
as raising awareness, training the personnel, harmonizing with high judicial decisions,
child-friendly court design). Afterwards, the Ombudsman Institution prepared a
report, which includes detailed evaluations and suggestions, and presented the report to
the Department of Administrative Services of the Presidency of Türkiye and the office
of the Speaker of the Grand National Assembly of Türkiye.
Monitoring Activities for Penitentiary Institutions
Within the framework of the Law No. 4681 on Penal Institutions and Prisons
Monitoring Boards, the legislation in force and the principles determined by the
international conventions to which Türkiye is a party, it has been decided to establish
prisons and detention houses monitoring boards in order to observe and examine
the management, operation and practices of penitentiary institutions and detention
houses on site, to obtain information and to report their findings to the authorized and
relevant authorities.
The periodic reports prepared by the monitoring boards were sent to the Ministry of
Justice, the Committee on Human Rights Inquiry of the Grand National Assembly of
Türkiye, and the Office of the Chief Public Prosecutor's in the jurisdiction where the
monitoring board is located. However, with the latest amendments made to the Law
on the Prisons and Detention Houses Monitoring Boards with the Law No. 7328
published in the Official Gazette on 17.06.2021, the periodic reports have also started
to be sent to the Ombudsman Institution, the Human Rights and Equality Institution
of Türkiye and the relevant Execution Judges.
As of 2022, there are 149 monitoring boards in 137 heavy penalty centers in Türkiye.
The Ombudsman Institution is informed that a total of 745 members, 563 men and
182 women, serve on these boards, and training had been given to the members of the
monitoring committee, which includes 120 lawyers, 50 doctors, 20 pharmacists, 46
academics, 232 teachers, 9 psychologists, 15 social workers, 5 retired prosecutors, 1
retired judge, 7 engineers and 240 people from other professions.
In order to enable monitoring boards to carry out inspections in penitentiary
institutions more effectively and to raise awareness about monitoring boards, the
Ministry of Justice has implemented the “Project for Increasing the Effectiveness of
Civil Monitoring Boards in Line with European Standards” with the technical support
