residence permit, stated that his application for Turkish citizenship was rejected by the
administration on the grounds that he did not meet the “requirement of having resided
resided in Türkiye for 5 years prior to the date of application”. The Ombudsman
Institution examined the application with the request to acknowledge that he meets
the residence requirement for citizenship and to reconsider the citizenship application.
Turkish Citizenship Law No. 5901 stipulates that foreigners who want to acquire
Turkish citizenship have to reside in Türkiye for five years, without interruption, prior
to her/his date of application and have the intention of settling in Türkiye and prove this
intention with action. Law No. 5901 also stipulates that residence for a foreigner is also
considered as residing in Türkiye with due respect to the Turkish laws. It is concluded
that, in this case, there is no contradiction to the law in the process of rejecting the
citizenship application of the complainant by the administration due to the failure to
fulfil the residence periods sought for foreigners in citizenship applications.
7.17 FORESTRY, WATER, ENVIRONMENT AND URBANIZATION
Under this title, applications are received by the Ombudsman Institution regarding
Housing Development Administration (TOKİ) applications, building registration
certificate, disaster housing, pasture occupation claims, chamber membership
cancellation requests, inspection of building inspection companies, applications
related to urban transformation, rental aid requests, zoning and settlement works,
environmental pollution, and noise pollution.
CASE SUMMARY
In this context, in an incident that was the subject of an application to the Ombudsman
Institution, the applicant was justified with the examination that the house was at risk
of disaster and that necessary measures should be taken as soon as possible, and the
administrations were issued a Recommendation to take concrete steps to solve the
problem. 23
The Ombudsman Institution received complaints arising from environmental pollution
and noise pollution in 2022. The Institution contributed to the solution of the problem
both with Referral Decisions and with Amicable Settlement Decisions. 24
