examine the application, because the application does not fall within the scope of the
Institution’s duty in this respect.

In accordance with Article 17 of Law No. 6328 and the first paragraph of Article 20
of the aforementioned Regulation, decision of unexaminability shall be issued for the
"disputes being handled or decided on by the judicial organs. 6
7.3 SCIENCE, ART, CULTURE AND TOURISM

The following subheadings are featured under the main title of “Science, art, culture
and tourism”;

2. Issues carried out by associations and foundations with cultural, artistic, tourism
and promotional activities and private law legal entities carrying out public

Applications lodged regarding the cancellation or unsuccessful results of associate
professorship applications, which are evaluated under the heading “Scientists and
scientific activities”, is the most frequent subject of the applications that the Institution
received in this field.

CASE SUMMARY

One of the complaints received by the Ombudsman Institution was about the
cancellation of the associate professorship application made in 2022 March term on
the grounds that the application was not duly filed. In the aforementioned cancellation,
the university claimed that it was because one of the applicant’s studies, which received
an ethical violation penalty in the application for the associate professorship in April
2018, was taken into account in the scoring of his application for the 2022 March term.
The complainant stated that he made his associate professorship application in 2018
in the field of Macroeconomics. At this time, one of the members of the jury drew
attention to the fact that his work was in the field of microeconomics, not in the field of
macroeconomics, therefore, the jury member stated that the complainant made a decision
