THE OMBUDSMAN INSTITUTION OF THE REPUBLIC OF TÜRKİYE

               7.6 CHILDREN’S RIGHTS

The Article 7 of the Law No. 6328, titled “Duties of the Chief Ombudsman and
Ombudsmen” stipulates that the Chief Ombudsman shall arrange division of labor
among ombudsmen, with one of the ombudsmen being assigned to deal with women
and child rights issues. In this context, applications received in the fields of “children’s
rights” and “women’s rights” are examined meticulously with the assignment made by
the Chief Ombudsman. The Ombudsman Institution is the only institution in our
country that receives direct applications from children.
               CASE SUMMARY

In this context, an application lodged to the Ombudsman Institution by a High School
student via the children’s website stated that there was a physical education class once
a week. However, the class was rarely taught because the teacher would not come.
According to the application, the class had been taught only five times since the school
term started, and the same grievance was valid for all classrooms in the school. The
applicant requested that the right to education be secured.

In order to take the necessary measures to ensure the cooperation of the different
bodies responsible for securing the rights of children at national and local level as set
out in the Convention on the Rights of the Child and the Constitution of Türkiye, the
Ombudsman Institution issued a Referral Decision to the relevant District Directorate
of National Education in order to take the necessary measures regarding the request of
               the applicant. 11
