THE OMBUDSMAN INSTITUTION OF THE REPUBLIC OF TÜRKİYE

The European Court of Human Rights reminded the importance of protecting
medical data in terms of exercising the right to respect for private life and upon the
determination that the applicable legislation did not clearly show the extent and the
way of the discretionary power granted to the competent authorities, it decided that
Article 8 of the Convention (right to respect for private and family life) was violated in
the applicant’s case. The court specifically emphasised that Latvian Law did not bring
any limitations to the scope of personal data that could be obtained by the institution
                 in question.
